The collegium, which is presided over by Chief Justice of India D Y Chandrachud, recommended Viswanathan and Prashant Kumar Mishra in its meeting on Tuesday in order to restore its full sanctioned strength of 34 judges, including the CJI.

Within the previous two days, Justice MR Shah and Justice Dinesh Maheshwari resigned from their positions, increasing the number of judges on the supreme court to 32.

If the recommendation is approved, Viswanthan will join the select group of solicitors who were immediately appointed from the Bar to the bench of the supreme court before going on to become the CJI.

The first Chief Justice of India to be promoted directly from the bar to the top court bench was Justice S M Sikri. The second name on the list was Justice U U Lalit.

Justice P. S. Narasimha, a judge of the supreme court, will become the third Chief Justice of India to be directly elevated from the Bar. Viswanathan, who was born on May 26, 1966, would hold the position of justice of the Supreme Court until May 25, 2031.

The collegium, which included justices S K Kaul, K M Joseph, Ajay Rastogi, and Sanjiv Khanna, recommended that Viswanathan be in line to succeed Justice Jamshed Burjor Pardiwala when he retires on August 11, 2030, and serve as Chief Justice of India until his retirement on May 25, 2031.

According to the recommendation, there is currently only one member (Justice P S Narasimha) who was appointed immediately to the Supreme Court bench from the Bar.

Viswanathan, a senior attorney, was chosen after the Collegium took into account the names of distinguished members of the Bar and determined that he is “eminently suitable for being appointed as a Judge of the Supreme Court.” “K V Viswanathan’s appointment will improve the representation of the bar in the Supreme Court’s makeup. Viswanathan is a well-respected Supreme Court Bar attorney. His extensive expertise and experience will significantly benefit the Supreme Court, according to the resolution.

It stated that Viswanathan had enrolled in the Bar Council of Tamil Nadu in 1988 after completing the five-year integrated law degree at Coimbatore Law College, Bharathiyar University.

According to the statement, Viswanathan has testified in several cases involving a variety of issues, including constitutional law, criminal law, business law, insolvency law, and arbitration.

It added that Viswanathan has a thorough knowledge of the law and is well-known in the legal community for his integrity and as an upright senior member of the Bar. “His stature as an eminent member of the Bar has been recognised by the Supreme Court in numerous cases where he was appointed to assist the Court as amicus curiae,” the statement read.

Viswanathan represented one of the petitioners in front of a five-judge Constitution bench during the most recent hearings in the Supreme Court on a group of cases seeking the legal recognition of same-sex marriage.
