Mohammed Faizal is an Indian politician, member of the Nationalist Congress Party (NCP), Member of Parliament (MP) and social worker. He was elected twice consecutively to the Lakshadweep Assembly. He hit the headlines in October 2023 when his Lok Sabha membership was suspended and reinstated for the second time that year.

Profession
After completing his MBA, Mohammed Faizal started working as a business consultant. Later, he joined the Nationalist Congress Party (NCP). In 2014, he won the Lok Sabha election and became the MP from Lakshadweep constituency. After winning the election, the NCP appointed him whip (disciplinary). From September 1, 2014 to March 13, 2016, he served as a member of the Standing Committee of Transportation, Tourism and Culture. On May 23, 2019, he was re-elected as member of Lakshadweep Lok Sabha. From September 13, 2019 to December 27, 2020, he served as a member of the Standing Committee on Personnel, Public Complaints, Law and Justice. On October 23, 2019, he was elected as a member of the Consultative Committee of the Ministry of Minority Affairs. On December 28, 2020, he became a member of the Home Affairs Committee. On January 11, 2023, a Kavarati court in Lakshadweep found him guilty of attempted murder and was sentenced to 10 years in prison and disqualified from being a member of the Lok Sabha. Mohammad Fazal filed a petition in the Kerala High Court seeking a stay on the conviction to avoid being disqualified from being an MP, which would have led to by-elections. On January 25, 2023, the Kerala High Court stayed the conviction of Faizal and other accused in the case until the appeal is processed, citing rare and exceptional circumstances. The court noted that while political decriminalization was important, it was equally important to avoid costly by-elections in the interest of society, saying:
Decriminalization of politics is a basic requirement of every democracy. As a constitutional court, it is our bounden duty to advance constitutional objectives, including political purity. However, these noble principles cannot be a reason to deny the application of the rule of law. The social interest in avoiding costly elections, and the fact that if a new election were held, the elected candidate could serve alone for a limited period, cannot be ignored by this Court. “
On March 29, 2023, the Lok Sabha Secretariat restored his membership. In August 2023, the Supreme Court asked the Kerala High Court to reconsider the decision to suspend Mohammad Fazal. On October 4, 2023, Mohammed Faizal was disqualified as an MP after the High Court refused to stay his conviction. On October 9, 2023, the Supreme Court ordered the reinstatement of Mohammed Faizal as a member of the Lok Sabha. His membership of the Lok Sabha was restored on November 2, 2023.

On January 11, 2023, he was sentenced to 10 years in prison and disqualified from being a member of the Lok Sabha by the Kavarati court in Lakshadweep in the attempted murder case. Of the 37 defendants, only four were convicted. Mohammad Fazal and his brother were among them. This case occurred in 2009, when he, his brother Saeed Mohammad Nurul Amin and some Nationalist Congress Party staff attacked Mohammad Saleh and seriously injured him. Mohammad Solih is the son-in-law of Prime Minister Said Saeed, the former leader of the Congress Party and the tenth Member of Parliament of Lakshadweep.

In November 2021, Mohammed Faizal was booked by the police on multiple charges, including public nuisance, disobeying an order duly promulgated by a public servant, negligent conduct likely to spread life-threatening disease infection, and the Disaster Management Act. He had previously joined members of the National Communist Party in protesting against the government for raising prices for public transport and basic services.
Corruption cases registered by CBI
In July 2022, India’s Central Bureau of Investigation (CBI) registered a corruption case against Mohammed Faizal, alleging irregularities in tuna sales resulting in a loss of Rs. 6 Crores to Fishermen. According to the CBI, some civil servants of the Lakshadweep Cooperative Marketing Federation (LCMF) and Mohammed Faizal did not follow proper tendering procedures and formalities while exporting tuna to Sri Lanka-based SRT General Merchants, where his nephew, Abdul Works by Le Razique. This resulted in heavy losses for LCMF. Mohammad Fazal denied the accusations in an interview. He claimed that he had handed over the documents they wanted to the CBI but there has been no report of their recovery, he said,
The CBI sought some documents which were provided. They even searched my home. But they reported zero recovery. Let’s see what further actions they take. We’ll see from there. ”
