Nick Carter has claimed that it is “factually impossible” that he attacked the person who accuses him of sexual abuse.
In documents filed Tuesday, May 7, in Nevada and obtained by PEOPLE, the Backstreet Boys singer, 44, filed a motion seeking a hearing and asking the court to grant him summary judgment on claims filed by Shannon Ruth “for sexual assault, intentional infliction of emotional pain and careless infliction of emotional pain.”
Also named in the petition are Melissa Schuman — the former teenage pop singer from the girl group Dream who accused Carter of raping her in his Santa Monica apartment in 2003 when she was 18 and he was 22 — her father Jerome Schuman and @ElaineMoo Twitter account. YouTuber and former actress Alexa Nikolas was also subpoenaed.
Ruth — who sued Carter for sexual assault in December 2022 — claims she was assaulted as a teenager more than 20 years ago, an incident a source close to the singer has denied.
“Ms. Ruth disagrees with much of the information contained in Mr. Carter’s motion for summary judgment,” her attorney, Mark Boskovich, told PEOPLE in an exclusive statement. “She looks forward to being able to express her side of the story in her opposition.”

Ruth claimed the pop star, then 21, sexually assaulted her on his tour bus after a concert at the Tacoma Dome in 2001, according to documents obtained by PEOPLE. TMJ and Rolling stone were the first to file a lawsuit.
In the latest filing, Carter provides evidence that disputes Ruth’s claim with security personnel and the band’s management confirming that the Backstreet Boys “quickly left” after a concert where she allegedly waited in line for autographs. (The singer’s team claims that such a line did not exist.)
Susan Riggs, a friend of the band and Carter at the time, testified that she “personally watched Carter walk out of the venue, get on his tour bus and immediately drive off,” while Ashley Large, a fan, went to a meeting before the show, but claims that there was no line for autographs after the show.
Additionally, fans confirmed that Carter was flown to the Four Seasons Hotel in Seattle immediately after the concert.
Carter’s lawyers claim that Ruth could not recall several details from the incident in question, including details about the drink called the “VIP Drink” she was allegedly served, how long it was from getting off the bus to the bathroom where she claimed to be. assaulted and how Carter told her to “orally steam” him.
The “As Long As You Love Me” singer also claims the accuser lied about giving her HPV and about identifying her security guard, who she claimed let him on the tour bus. He also pointed out in the submission that Ruth’s claims that she has been diagnosed with autism and cerebral palsy are unsubstantiated.
Carter claims that Ruth was “trained and groomed” by Melissa and Jerome and that Ruth admitted on social media and in her testimony that she was not sexually assaulted by the bandits.
“Carter is entitled to summary judgment in this case and should not be forced to proceed to trial in a case in which the plaintiff has failed to present any credible evidence to support her claims,” the filing contends.
The musician asks the court to ignore Ruth’s “perjury”.
“Based on the actual and substantial evidentiary record, Carter did not rape Ruth and her moving target story does not create a genuine issue on which a reasonable jury would find in her favor,” the motion states.

Judge says Nick Carter can proceed with his counterclaim against sexual assault defendants
Since 2017, Carter has faced accusations of sexually assaulting three women.
Schuman sued Nick for sexual assault and battery in April 2023, while Ruth sued him in December 2022 for alleged sexual abuse.
A source close to Nick denied the allegations. In February 2023, Nick filed a counterclaim against Ruth over her allegations, and in that counterclaim he also sued Schuman regarding the allegations she made against him.
The countersuit alleged that the two women took advantage of the #MeToo movement and used it to launch a five-year conspiracy to “defame and defame Carter and otherwise destroy his reputation in order to gain attention and fame and/or extort money from Carter,” according to the lawsuit. got PEOPLE.
Nick was sued by a third accuser who claimed he assaulted her when she was 15 in August 2023.
According to documents obtained by PEOPLE, he allegedly sexually assaulted her on multiple occasions in 2003.
Carter’s attorney denied the allegations.
