A Los Angeles court has granted Steven Tyler’s request to dismiss parts of a sexual assault lawsuit filed against him in 2022 by a woman who claims she had sex with the Aerosmith rocker when she was a teenager in the 1970s.
A court ruled Wednesday that it will throw out portions of Julia Misley’s lawsuit against Tyler that alleged she suffered “intentional infliction of emotional distress” (IIED) based on Tyler’s publication of his memoir.
After Misley first filed suit in December 2022 alleging sexual assault, sexual assault and IIED, Tyler, 75, responded by arguing that she could not use his memoir as a cause of emotional distress in court because it was free speech and his the writings do not identify her.
He said in court documents that his memoirs were published in 1997 and 2011, and because Misley didn’t sue until 2022, her IIED claim was barred by the two-year statute of limitations. He also argued that her claims were barred by the First Amendment because his memoirs “convey his own experiences from his life worthy of publication.”
Attorneys for Misley did not immediately respond to PEOPLE’s request for comment, while Tyler’s rep declined to comment.

Misley said she had sex with the star when she was a teenager, and that the “Dream On” singer convinced her mother to give him custody of her when she was 16 so they could continue their relationship.
Although she did not name Tyler in her lawsuit, her claims were consistent with comments he made in his 2011 memoir. Does the noise in my head bother you? about a relationship with a 16-year-old girl. Misley ended up naming Tyler in a follow-up statement.
Tyler’s memoirs don’t mention Misley’s name, though he does say he “almost took a teenage bride” because “her parents fell in love with me, signed the paper to give me custody so I wouldn’t get arrested if I took her out of state. I took her with me on tour.”

In April, Tyler responded to Misley’s lawsuit denying all the allegations against him and stating that she consented to their sexual relationship. He also claimed immunity as her legal guardian and asked for the lawsuit to be dismissed (her lawyer suggested that Tyler had “taken a shine to her”).
Tyler’s latest court victory comes months after another woman filed a sexual assault lawsuit against him in November, alleging he assaulted her twice in one day — including groping and simulated sex — when she was a teenager in 1975.
That lawsuit was dismissed in February, with a New York judge ruling that the prosecutor waited too long to bring the case to light and did not meet the requirements under a New York City law that allows abuse victims to speak about decades-old crimes.
