They strongly believe that this legal action will shed light on the events surrounding Maya’s medical journey and help prevent similar tragedies from befalling other families. The eagerly awaited trial is set to begin in September 2023, giving Maya’s family an opportunity to share their story and seek the answers they so desperately seek.

What happened to Maya Kowalski?

Her mother, Beata, believed Maya was suffering from complex regional pain syndrome (CRPS), also known as a poorly understood condition characterized by persistent, severe and debilitating pain. Seeking specialized treatment, they turned to Dr. Anthony Kirkpatrick, a Florida-based anesthesiologist and pharmacologist with expertise in CRPS.

dr. Kirkpatrick gave Maya ketamine, an anesthetic drug, by IV and later induced a “ketamine coma,” a state of sleep that lasted five days, in an attempt to reset her nervous system. Since the treatment was not yet approved by the FDA, the family traveled to Mexico to undergo it. At first, Maya thought the treatment was effective, but a year later she was rushed back to the hospital with excruciating abdominal pain.

When Beata informed the doctors about Maya’s diagnosis of CRPS and the need for high doses of ketamine, the hospital staff became suspicious. They turned to the child protection service, which subsequently accused Beata of Munchausen syndrome through a power of attorney (MSP). This mental health condition involves a caregiver or parent who makes up or induces symptoms in a child, making it appear that the child is ill.

Because of this, Maya was temporarily taken away from parental custody for three months. However, after a comprehensive psychological evaluation ordered by the court, Beata was cleared of any mental illness. Tragically, after being separated from her daughter for 87 days, Beata was found dead, leaving behind a heartbreaking note expressing her pain at being separated from Maya and facing abuse. Just five days later, Maya was reunited with her father and handed custody to him.
