Pritinker Diwaker was registered as a solicitor in 1984 and handles cases involving constitutional, civil and criminal matters. In 1984, he served as the Presiding Judge of the Madhya Pradesh High Court. During his career, he has served as standing counsel to many large organizations such as SAIL (Steel Authority of India Limited), State Bank of India, Chhattisgarh Grameen Bank, Bank of Baroda, IDBI, Central State Financial Corporation, Kotak Mahindra Bank, Raipur Dugdh Sangh, CBSE (Central Board of Secondary Education) and many municipal corporations. In 2000, when the Chhattisgarh High Court was established, Diwak moved to Bilaspur in Chhattisgarh. In 2005, the Chhattisgarh High Court appointed him as senior advocate. He served on the Madhya Pradesh Bar Council for seven years and subsequently on the Chhattisgarh Bar Council for five years.
Judge and Chief Justice
In 2009, the Judicial Council invited him to serve as a judge of the Chhattisgarh High Court. He was transferred to the Allahabad High Judicial Court on October 3, 2018. On February 13, 2023, he was appointed as the Acting Chief Justice of the Allahabad High Judicial Court (now known as Prayagraj). This temporary job later became his official position: Chief Judge of the Allahabad High Court. A Supreme Court bench including Chief Justice of India DY Chandrachud, Justices Sanjay Kishan Kaul and KM Joseph unanimously agreed that Justice Diwak should be the next chief justice of the Allahabad High Court. The central government approved this decision on March 24, 2023. Divac was sworn in as Chief Justice on March 26, 2023. He will retire in November 2023.

Children in conflict with law apply for anticipatory bail
Mohd. Zaid v. State of UP: The Allahabad High Court was asked whether children in conflict with the law can claim anticipatory bail under the Criminal Procedure Code. The court, headed by Justices Pritinker Diwaker and Samit Gopal, agreed. Although the Juvenile Justice Care and Protection Act, 2015 talks about how the Code of Criminal Procedure applies, it does not prevent a child from seeking anticipatory bail. However, the court can decide whether to grant bail. But unless there is a specific reason not to do so, the child can claim anticipatory bail.
Kanpur bar association strike
In 2023, a seven-judge bench of the Allahabad High Court, including Chief Justice Diwak, issued notices to lawyers participating in a strike organized by the Kanpur Bar Association and Bar Association. The notice was in response to a public interest litigation (PIL) and directed the lawyers to be charged with contempt of court if they did not return to work. The lawyers ignored court orders and went on strike, leading the court to file contempt charges against them for “paralyzing the work of justice” in Kanpur since March 2023.

The Allahabad High Court’s acquittal of an acid attack convict did not satisfy beyond a reasonable doubt that the person was guilty nor satisfy the judge’s conscience. The convict was sentenced to life imprisonment and fined under the Indian Penal Code. Putinque Divac said that if there are two possible views, one that the defendant is innocent and the other that the defendant is guilty, the one that favors the defendant should be chosen. The criminal was found not guilty and released without charge.
Javapi Property Rights Dispute
In 1991, Lord Vishweshwar, the idol of Swayambhu, and others filed a lawsuit in the Varanasi District Court, demanding the demolition of the Jawapi Masjid and the return of the land to the Hindus. On April 8, 2021, the Varanasi Civil Court allowed the Archaeological Survey of India (ASI) to conduct a physical survey of the Jawapi Masjid adjacent to the Kashi Vishwanath Temple. Anjuman Intezamiya Masajid of Varanasi opposed the order and sought relief from the high court, which led to a stay of proceedings in lower courts, including the ASI probe into Gyanvapi.
Chief Justice Pritinker Diwaker found problems with the way the case was being handled. He pointed out that although Justice Padya (the single judge overseeing the case) had reserved the judgment on March 15, 2023, it was not delivered on time. Despite this, the cases continued to be heard by the same judges, which Chief Justice Divac found deeply problematic. Chief Justice Diwak withdrew the case from Justice Padiya due to problems and delays. Divac retired before the case was concluded.

Controversy surrounding transfer to Allahabad High Court
At his retirement ceremony in Prayagraj (formerly known as Allahabad) in Uttar Pradesh, Justice Pritinker Diwaker spoke out against the commission and criticized their conduct. In his valedictory speech, he said his transfer from the Chhattisgarh High Court to the Allahabad High Court (HC) was done by a group (Judicial Council of India) led by former Chief Justice of India Dipak Misra for ” “Harassed” Divac.
He sparked controversy by saying the transfer was unfair. Diwak was transferred to the Allahabad High Court in 2018. In his farewell speech, Divac said,
My transfer order appears to be a malicious attempt to harass me. Fortunately, however, the bane turned out to be a blessing for me, as I had the immeasurable support and cooperation of my fellow judges and members of the Bar. ”
He also thanked Chief Justice of India DY Chandrachud for correcting “injustice” by recommending Diwak to take over as Chief Justice of Allahabad High Court.
