Diplo is being sued over allegations of revenge pornography.

Jane Doe claims she had an intimate relationship with the DJ/producer, 45, from 2016 to 2023 and that he sent sexually explicit photos and videos of her to third parties, according to court documents obtained by PEOPLE.

In the complaint, the New York-based woman alleges that between 2018 and 2023, Diplo — whose real name is Thomas Wesley Pentz — filmed himself having sex with her on numerous occasions without her consent and “disclosed and/or distributed the images and videos to third parties via text messages and Snapchat.”

According to the filing, the unnamed woman and Diplo began communicating on Snapchat in April 2016 when she was 21 years old. They exchanged “pornographic images” between April 2016 and June 2016, before meeting in the musician’s New York hotel room in June 2016.

They maintained an intimate relationship, including sex, from June 2016 to October 2023.

During that time, Doe made it known that she “did not want Defendant Diplo to film them engaging in sexual activity without her express consent nor did she want him to distribute the images and/or videos to third parties and she never gave him consent to do so do,” the lawsuit states.

On some occasions, the unnamed plaintiff gave Diplo permission to film them having sex, and she “never gave him permission to distribute those images and videos to third parties and reiterated that he was not to film them without her express consent.”

In November 2023, Doe claims she was contacted for the first time by a third party and revealed that she was in possession of “intimate material” showing her and the “Electricity” artist having sex. Doe was allegedly told that an unnamed party received explicit photos and videos on October 14, 2018, showing her “genitalia, rear and face.”

On Nov. 7, 2023, the unnamed plaintiff filed a police report and within days, “the NYPD issued an arrest warrant for defendant Diplo for distributing intimate images and/or videos depicting” Doe, according to the filing.

“Diplo’s actions represent a grave abuse of power and a flagrant disregard for human dignity,” Micha Liberty, Doe’s attorney at Liberty Law, said in a statement. It is imperative that we as a society condemn such actions and hold the perpetrators accountable.”

Doe’s attorney Margaret E. Mabie of Marsh Law added, “Our courageous client’s story is one of Diplo’s many worst-kept secrets, and bringing this case is her first step in creating a path to civil justice.”

The NYPD would not confirm whether there is an active warrant for Diplo, but acknowledged that it is an active investigation.

“There is a felony charge of unlawful dissemination on file for a suspect named Thomas Pentz that is currently being investigated by NYPD detectives,” the Deputy Commissioner, Spokesperson for Public Information (DCPI) told PEOPLE in a statement.

Helene M. Weiss, another Doe attorney at Marsh Law, commented on DJ’s “alleged unacceptable pattern of conduct,” saying in a statement that she “hopes this litigation can serve as a catalyst to end the defendant’s repeated victimization of women once and for all .”

This is the second charge Diplo has faced for sharing intimate photos without someone’s consent. He has denied the previous charges, one lawsuit has been dismissed and one is pending.

In August 2023, Shelly Auguste, who was granted a restraining order against Diplo in 2020, filed a police report against the artist claiming he distributed nude photos without her consent.

The LAPD turned the case over to the Los Angeles City Attorney’s office in November and it was under review, Pitchfork reported. The allegations, which Diplo denied, first came to light in 2020.

Auguste is currently suing DJ, alleging sexual assault, gender-based violence, intentional invasion of privacy, harassment, assault, defamation, intentional infliction of emotional pain and fraud, as well as violations of the Ralph Civil Rights Act and violations of the Tom Bane Civil Rights Act, the publication announced.

Another unnamed plaintiff sued Diplo in July 2021, claiming he wouldn’t let her leave a room at an after party in Las Vegas until she performed oral sex with him and alleging he may have filmed it. Diplo denied the incident and the following week Doe dropped the lawsuit, Rolling stone reported at the time.
